I acknowledge and agree to these waiver terms as a condition of my participation and the participation of each child or other participant for whom I am authorized to sign at Hily’s Sparkly Spa, located at 207 Edgeley Blvd #5, Concord, Ontario L4K 4B5.
1. Assumption of Risk
I understand and acknowledge that participating in activities at Hily’s Sparkly Spa involves inherent risks, including but not limited to physical injury, property damage, and other potential hazards. I voluntarily assume all risks associated with my presence at Hily’s Sparkly Spa and the participation of my child(ren) in the activities.
2. Food and Beverages
I understand and agree that the consumption of food and beverages brought to Hily’s Sparkly Spa is at my sole risk. Hily’s Sparkly Spa does not provide or handle food or beverage service for us. Any food or beverages are the responsibility of the party host and, where applicable, the third-party catering service selected by the party host. I agree to hold Hily’s Sparkly Spa harmless from claims or damages arising from the consumption or handling of those food and beverages.
3. Supervision of Children
I agree and understand that I am solely responsible for supervising and monitoring my child(ren) during the entire duration of our visit to Hily’s Sparkly Spa. I will ensure that my child(ren) will behave responsibly and follow all safety guidelines and instructions provided by Hily’s Sparkly Spa staff.
4. Release of Liability
In consideration of being permitted to participate in the activities and use the facilities at Hily’s Sparkly Spa, I, on behalf of myself and my child(ren), hereby release, waive, discharge, and covenant not to sue Hily’s Sparkly Spa, its owners, employees, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or illness, including death, that may be sustained by myself, my child(ren), or any property while at Hily’s Sparkly Spa.
5. Indemnification and Acknowledgement
I agree to indemnify and hold harmless Hily’s Sparkly Spa, its owners, employees, and representatives from any and all liabilities, costs, expenses, or damages arising from claims or actions brought by third parties resulting from my actions or the actions of my child(ren) while at Hily’s Sparkly Spa. I confirm that I have read and understand these waiver terms and sign voluntarily with knowledge of their significance and legal consequences.
