I, hereby acknowledge and agree to the terms and conditions of this liability waiver as a condition of participating in the activities and using the facilities provided by Hily’s Sparkly Spa located at 207 Edgeley Blvd unit # 5, Concord, ON L4K 4B5.

1. Assumption of Liability: I understand and acknowledge that participating in activities at Hily’s Sparkly Spa involves inherent risks, including but not limited to physical injury, property damage, and other potential hazards. I voluntarily assume all risks associated with my presence at Hily’s Sparkly Spa and the participation of my child(ren) in the activities.

2. Consumption of foods and beverages. I understand and agree that the consumption of any foods and beverages at Hily’s Sparkly Spa is at my sole risk. Hily’s Sparkly Spa has not provided any food or beverage service to us and all said consumed foods and beverages are a sole responsibility of the host of the party and not of Hily’s Sparkly Spa . Said foods and beverages were catered by a third-party catering service upon the request of the party host, and Hily’s Sparkly Spa is not responsible for the handling of said foods and beverages. I agree to hold Hily’s Sparkly Spa harmless and release the Venue for any claims or damages that may arise as the result of the consumption of the said foods and beverages at Hily’s Sparkly Spa.

3. Supervision of Children: I agree and understand that I am solely responsible for supervising and monitoring my child(ren) during the entire duration of our visit to Hily’s Sparkly Spa. I will ensure that my child(ren) will behave responsibly and follow all safety guidelines and instructions provided by Hily’s Sparkly Spa staff.

4. Photography and Social Media: I consent to the use of any photographs, videos, or recordings taken of me and my child(ren) during our visit to Hily’s Sparkly Spa. I understand that Hily’s Sparkly Spa may use these images for promotional purposes on social media or other marketing materials without any further consent or compensation.

5. Use of Email Address: I authorize Hily’s Sparkly Spa to use my email address to send future promotional materials, special offers, and relevant information about the Venue. I understand that I may opt-out from receiving such communications at any time.

6. Release of Liability: In consideration of being permitted to participate in the activities and use the facilities at Hily’s Sparkly Spa , I, on behalf of myself and my child(ren), hereby release, waive, discharge, and covenant not to sue Hily’s Sparkly Spa , its owners, employees, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or illness, including death, that may be sustained by myself, my child(ren), or any property while at Hily’s Sparkly Spa .

7. Indemnification: I agree to indemnify and hold harmless Hily’s Sparkly Spa, its owners, employees, and representatives from any and all liabilities, costs, expenses, or damages arising from any claims or actions brought by third parties resulting from my actions or the actions of my child(ren) while at the Venue. I have read and fully understand the terms of this liability waiver, and I voluntarily sign it with full knowledge of its significance and legal consequences.
